KATHMANDU, Oct 27 - Issuing an interim stay order, the Supreme Court (SC) today blocked the government’s attempt to revoke the operating license of Kantipur FM. The court ordered the government not to take any action against the FM untill Sunday.
A special bench comprising Chief Justice Dilip Kumar Paudel and justices Sharada Shrestha and Top Bahadur Magar issued the order. Earlier this morning, Managing Director of Kantipur FM, Binod Raj Gyawali filed a writ petition at the SC, challenging the government warning to revoke the FM’s operating license.
In his writ, Gyawali had sought a stay order from the SC against the government threat. The Apex Court began hearing on the writ this afternoon. In a threatening letter sent to the FM yesterday, the government gave it a 24-hour deadline to furnish written clarification mentioning reasons as to why the FM’s license should not be cancelled as “it was found airing news despite the promulgation of the recent media ordinance.
The letter also said the government would revoke the FM’s license if it fails to furnish a “satisfactory” clarification or if no clarification is furnished within the 24-hour deadline. The government action followed a SC order seeking written clarification from the government after preliminary hearing on a writ filed by the FM over the seizure of uplinking equipment from its office in Lalitpur last Friday midnight. The case is still under SC consideration and hearing on it will resume coming Sunday.Both the ordinance and the government warning to the FM have drawn widespread criticism from national and international communities.
SC decision raises hopes Meanwhile, reacting to the Supreme Court’s decision, the general secretary of the Federation of Nepalese Journalists (FNJ) Mahendra Bista said, “The court’s decision has given people hope that they can now get justice,” adding, “The government should also learn a lesson from this that it should revoke the black ordinance and stop imposing curbs on the media.”
Similarly, Nepal Bar Association president Shambu Thapa said, “The unconstitutional government’s orders can be thwarted if the apex court gives verdicts independently and most effectively,” adding, “We have to still struggle a lot in order to protect press freedom and the people’s right to information.”
Likewise, the Acting General Secretary of CPN-UML Bam Dev Gautam said, “This puppet government is functioning with a defeated mentality and it is time for the court to defend the media and the rule of law if it wants to retain its existence. ”
“I am glad that the court has given the stay order against the government,” he added.
Nepali Congress President Girija Prasad Koirala said, “The court’s stay order has given us a little hope that at least the court is not so biased as this autocratic government.
